PRIVACY POLICY INTRODUCTION

Title V of the Gramm-Leach-Bliley Act generally prohibits any financial institution, directly or through its affiliates, from sharing nonpublic personal information about you with a nonaffiliated third party unless the institution provides you with a notice of its privacy policies and practices, such as the type of information that it collects about you and the categories of persons or entities to whom it may be disclosed. In compliance with the Gramm-Leach-Bliley Act, we are providing you with this Privacy Policy Notice, which sets out the privacy policies and practices of Legacy Title Agency​​.

We believe that, in making you aware of how we use your nonpublic personal information, and to whom it is disclosed, this will form the basis for a relationship of trust between us and the public that we serve.

We limit access to your nonpublic personal information only to those employees who need such access in connection with providing products or services to you or for other legitimate business purposes.

Disclosure of Nonpublic Personal Information

‍We may disclose your nonpublic personal information with our affiliates, such as insurance companies and other real estate settlement service providers. We also may disclose your nonpublic personal information to:

  • agents, brokers or representatives to provide you with services you have requested; ‍

  • third-party contractors or service providers who provide services or perform marketing or other functions on our behalf; and

  • others with whom we enter into joint marketing agreements for products or services that we believe you may find of interest.

We may also disclose your Personal Information to others when we believe, in good faith, that such disclosure is reasonably necessary to comply with the law or to protect the safety of our customers, employees, or properly and/or to comply with a judicial proceeding, court order, or legal process.

In addition, we will disclose your nonpublic personal information when you direct or give us permission, when we are required by law to do so, or when we suspect fraudulent or criminal activities. We also may disclose your nonpublic personal information when otherwise permitted by applicable privacy laws such as, for example, when disclosure is needed to enforce our rights arising out of any agreement, transaction, or relationship with you.

Former Customers

‍ ‍Even if you are no longer our customer, our Privacy Policy will continue to apply. We may store such information indefinitely, including the period after which any customer relationship ceased. Such information may be used for an internal purpose, such as quality control efforts, auditing, and customer analysis.

Internet Web Sites

‍ ‍Legacy Title Agency​​’s web sites may use “cookies” to improve the level of service to visitors. Cookies are lines of text that are transmitted to a web browser and temporarily stored on the visitor’s hard drive. When the visitor logs out of the website, these cookies are erased. When the visitor returns to the Legacy Title Agency​​ web site the cookies will be transmitted again. These cookies do not collect personal identification information and Legacy Title Agency​​ does not combine information collected through cookies with other personal information to determine a visitor’s identity or e-mail address. Browsers can be configured to notify visitors when cookies are about to be received and provide visitors with the option of refusing cookies.

LEGACY TITLE AGENCY​​- TERMS OF SERVICE

1. Acceptance of These Terms

These Terms of Service (the "Terms") are a binding agreement between you and Motor City Title Agency, LLC d/b/a Legacy Title Agency ("Legacy Title," "we," "us," or "our"). They govern your access to and use of legacyclosings.com, including its pages, information, sample forms, other forms, document-upload tools, customer or professional portals, ordering functions, payment features, communications, and other online services that link to these Terms (collectively, the "Website"). By accessing or using the Website, submitting information, creating or using an account, requesting or ordering services, uploading documents, or making a payment through the Website, you acknowledge that you have read and agree to these Terms. If you do not agree, do not use the Website, its links, or any other Legacy Title internet content. If you use the Website for a company, lender, brokerage, law firm, real estate agency, or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.

2. Eligibility and Authorized Use

You must be at least 18 years old and legally capable of entering into a binding contract to use transactional features of the Website. You may use the Website only for lawful purposes and in accordance with these Terms. Real estate professionals and other business users are responsible for ensuring that their personnel and agents comply with these Terms.

3. Website Information Is General Information Only

Website content is provided for general informational and administrative purposes. It is not legal, tax, financial, investment, real estate brokerage, underwriting, or insurance advice; it is not a title opinion; and it does not create an attorney-client, fiduciary, broker-client, insurer-insured, escrow, or other professional relationship. You should consult appropriately licensed advisers regarding your circumstances. Real estate, title, escrow, settlement, underwriting, recording, and insurance requirements vary by transaction and may change. Website content may be incomplete, summarized, or outdated. Do not rely on it as a substitute for transaction-specific documents, professional advice, or verification with the appropriate public office, underwriter, lender, or other party.

4. Requests and Orders; No Automatic Acceptance

A contact form, quote request, service request, preliminary order, uploaded document, or online payment is a request for Legacy Title to review or process the submission; it does not by itself obligate Legacy Title to accept an engagement, open an escrow, issue a commitment or policy, insure title, close a transaction, record an instrument, or provide any other service. We may accept, reject, suspend, or request additional information regarding any submission, subject to applicable law and existing written obligations. Any estimate, quote, fee calculator result, turnaround time, closing date, title status, or similar Website statement is preliminary unless expressly confirmed in a transaction-specific writing by an authorized representative. Fees, premiums, taxes, recording charges, governmental charges, payoff amounts, and third-party costs may change.

5. Controlling Transaction Documents

Title and settlement services are governed by applicable law and the specific documents for the transaction, which may include a title commitment, title insurance policy and endorsements, rate filing, escrow agreement, closing protection letter, settlement statement, lender or customer instructions, purchase agreement, authorization, and separate service agreement (collectively, "Transaction Documents"). If these Terms conflict with a Transaction Document, the Transaction Document controls with respect to that transaction. Coverage exists only as stated in an issued title insurance policy; a commitment is an offer to issue a policy subject to its requirements, exceptions, conditions, and exclusions. Nothing on this website or any other Legacy Title educational materials including presentations, fliers, handouts, videos or other materials may affect or interpret the terms and conditions of any policy, commitment or other Transaction Document. Nothing on the Website expands, modifies, or waives any policy provision, underwriting requirement, escrow condition, legal duty, or contractual right. Website availability or an electronic status display does not establish that funds are collected, documents are recordable, conditions are satisfied, coverage is effective, or a transaction is cleared to close or closed.

6. Accounts, Portals, and Credentials

Some features may require an account or access through a third-party portal. You must provide accurate information, keep credentials confidential, use reasonable security measures, and promptly notify us at legal@legacyclosings.com of suspected unauthorized access. You are responsible for activity occurring through credentials assigned to you, except to the extent prohibited by law. Do not share portal access with anyone who is not authorized for the applicable transaction. We may suspend or terminate access to protect users, transactions, systems, or information; investigate suspected misuse; comply with law or third-party requirements; or enforce these Terms. Portal availability may depend on third-party providers and is not guaranteed.

7. Uploads, Instructions, and Electronic Communications

You represent that you have the right and authority to submit all information and documents you provide and that doing so does not violate law, confidentiality obligations, privacy rights, court orders, or third-party rights. You grant Legacy Title and its service providers a limited, nonexclusive right to host, copy, transmit, review, process, and use submitted materials as reasonably necessary to operate the Website, evaluate or provide requested services, administer transactions, prevent fraud, meet underwriting or legal obligations, and maintain records. Electronic messages and portal entries may be delayed, incomplete, intercepted, altered, misdirected, or fraudulent. Do not use ordinary email or unsecured forms to send Social Security numbers, bank credentials, or other highly sensitive information unless we specifically direct you to an approved secure method. Uploading a document does not prove that it was received, reviewed, approved, accepted for recording, or sufficient for closing. You consent to receive transactional communications electronically at the contact information you provide. You are responsible for keeping that information current. You may retain a copy of these Terms and electronic communications. Certain notices or documents may still be provided on paper when required or appropriate.

8. Wire-Fraud and Payment Security

REAL ESTATE TRANSACTIONS ARE FREQUENT TARGETS OF WIRE AND PAYMENT FRAUD. NEVER RELY SOLELY ON AN EMAIL, TEXT MESSAGE, WEBSITE POP-UP, OR UNVERIFIED PORTAL MESSAGE TO SEND FUNDS OR CHANGE PAYMENT INSTRUCTIONS. BEFORE SENDING FUNDS, INDEPENDENTLY VERIFY THE INSTRUCTIONS BY CALLING A KNOWN, TRUSTED TELEPHONE NUMBER FOR LEGACY TITLE. DO NOT USE A TELEPHONE NUMBER OR LINK CONTAINED ONLY IN THE MESSAGE REQUESTING THE PAYMENT OR CHANGE. Legacy Title will not be responsible for funds sent to an incorrect or fraudulent account based on instructions that were not independently verified, except to the extent liability cannot lawfully be limited. Immediately contact your financial institution and Legacy Title if you suspect fraud or an erroneous transfer.

9. Online Payments

Online payment functionality may be operated by Legacy Pay / CertifID and may be subject to that provider's terms and privacy practices. You authorize the applicable charges and represent that you are authorized to use the selected payment method. A confirmation screen or receipt confirms only that a submission was received; it does not necessarily confirm final settlement, acceptance, availability of funds, satisfaction of transaction conditions, or completion of services. You remain responsible for all amounts due under the applicable Transaction Documents, including any returned-payment, reversal, chargeback, bank, recording, governmental, or third-party charges permitted by law. Do not initiate a chargeback for a transaction-specific dispute without first contacting Legacy Title at disbursements@legacyclosings.com. Refunds, reversals, and corrections are governed by applicable law and the applicable Transaction Documents.

10. Prohibited Conduct

You may not, and may not assist another person to: ·         use the Website for fraud, impersonation, money laundering, unauthorized practice, unlawful discrimination, harassment, or any other illegal purpose; ·         submit false, misleading, altered, forged, malicious, infringing, or unauthorized information or documents; ·         attempt to gain unauthorized access to an account, transaction, system, network, database, or nonpublic information; ·         introduce malware or harmful code; probe, scan, or test vulnerabilities without written authorization; or interfere with Website operation or security; ·         scrape, harvest, index, copy, frame, mirror, reverse engineer, or use automated means to access the Website except as expressly authorized in writing or permitted by law; ·         circumvent access controls, remove proprietary notices, or use Website content to build a competing database or service; or ·         use another person's personal, financial, transaction, or login information without lawful authority.

11. Intellectual Property

The Website and its content, design, text, graphics, logos, trademarks, software, compilations, and other materials are owned by or licensed to Legacy Title and are protected by intellectual property and other laws. Subject to these Terms, Legacy Title grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Website for your personal or internal business purposes in connection with legitimate real estate transactions or evaluation of our services. No ownership right is transferred. You may not use the names, logos, trade dress, or other marks of Legacy Title without prior written permission. Any feedback you voluntarily provide may be used by Legacy Title without restriction or compensation, provided we do not publicly identify you without permission.

12. Privacy and Information Security

Our collection, use, disclosure, retention, and protection of personal information are described in our Privacy Policy at  https://www.legacyclosings.com/privacy-policy and, when applicable, privacy notices provided in connection with particular financial or insurance services. Those notices are incorporated by reference to the extent applicable. If these Terms conflict with a legally required privacy notice, the privacy notice controls as to the covered information. No method of transmission or storage is completely secure. We use safeguards we consider reasonable and appropriate, but we cannot guarantee that the Website, communications, or submitted information will be free from unauthorized access, loss, misuse, or alteration.

13. Third-Party Services and Links

The Website may link to or integrate with portals, payment processors, underwriters, county or governmental systems, mapping or property-data services, electronic-signature providers, lenders, vendors, and other third parties. Legacy Title does not control and is not responsible for third-party services, content, availability, security, accuracy, terms, or privacy practices. Your use of third-party services may be governed by separate terms. A link or integration is not an endorsement except where expressly stated.

14. Website Availability and Changes

We may update, modify, suspend, or discontinue Website features at any time. Maintenance, outages, cyber incidents, third-party failures, internet conditions, or events beyond our control may affect access. The Website is not an emergency service or guaranteed method for delivering time-sensitive closing instructions, notices, payoff demands, legal process, cancellation requests, or recording directives. Confirm urgent or deadline-sensitive matters directly with an authorized Legacy Title representative.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE IS PROVIDED "AS IS" AND "AS AVAILABLE." LEGACY TITLE DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES REGARDING THE WEBSITE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND FREEDOM FROM HARMFUL CODE. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, CURRENT, COMPLETE, OR SUITABLE FOR ANY PARTICULAR TRANSACTION. 17. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless the Legacy Title parties from third-party claims, losses, liabilities, damages, judgments, penalties, costs, and reasonable attorneys' fees arising from your unlawful or unauthorized use of the Website; your violation of these Terms; or information or documents you submit without required rights or authority. This section does not require a consumer to indemnify a Legacy Title party for that party's own unlawful conduct, negligence, or breach of duty, and it does not alter rights or obligations under a Transaction Document.

18. Governing Law and Venue

These Terms and disputes arising from the Website are governed by the laws of the State of Michigan, without regard to conflict-of-law principles, except to the extent federal law applies. Subject to any controlling Transaction Document and any nonwaivable law, the state and federal courts located in the Michigan county where Legacy Title's principal office is located will have exclusive jurisdiction, and each party consents to personal jurisdiction and venue there. Nothing in these Terms prevents either party from seeking temporary or emergency injunctive relief in a court of competent jurisdiction.

19. Changes to These Terms

We may revise these Terms by posting an updated version and changing the Effective Date. Changes apply prospectively when posted unless a later date is stated. If required by law, we will provide additional notice or obtain consent. Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms. The version in effect when a particular Website interaction occurs governs that interaction, while Transaction Documents continue to govern their respective transactions.

20. Termination

You may stop using the Website at any time. We may restrict or terminate your Website access if we reasonably believe you violated these Terms, created a security or legal risk, misused a transaction or account, or if access is no longer offered. Provisions that by their nature should survive will survive, including those concerning intellectual property, disclaimers, limitations, indemnification, dispute terms, and controlling Transaction Documents.

21. Miscellaneous

These Terms, together with policies expressly incorporated by reference, are the entire agreement regarding the Website and supersede prior Website-related understandings. They do not supersede Transaction Documents. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. A waiver must be in writing and applies only to the specific instance. You may not assign these Terms without our written consent; Legacy Title may assign them in connection with a merger, reorganization, sale of assets, or by operation of law. Section headings are for convenience only. "Including" means "including without limitation."
